Introduction to the Terms of Use: Our online store welcomes you and informs you that below are the terms and conditions governing your use of this store and all legal effects resulting from your use of the store's services via the internet platform, where the use of any person, whether a consumer of the service or product of the store or otherwise, constitutes approval and acceptance by him and is fully competent legally and systemically and legally for all articles and provisions of this agreement. Article Two - Legal Capacity of the Consumer: 1- The consumer acknowledges that he has legal capacity recognized by Sharia and system to deal with the store, or that his age is not less than eighteen years. 2- The consumer agrees that if he violates this article, he bears the consequences of this violation before others. Article Three - Nature of Obligation: 1- The store's obligation towards consumers is to provide (the service or product). 2- The store may provide other services such as after-sales services or related services, depending on the nature and type of (the service or product) requested by the consumer. Article Four - Usage Regulations: 1- The consumer commits to using the store’s electronic platform in accordance with public morals and the applicable regulations in the Kingdom of Saudi Arabia. 2- The consumer commits that when purchasing a service or product from this store, he will not use this service or product in a manner that violates public morals and the applicable regulations in the Kingdom of Saudi Arabia. Article Five - Accounts and Registration Obligations: Upon applying for membership in this store as a user, you are obliged to disclose specific information and choose a username and a secret password to be used when accessing the store’s services. By doing so, you agree to: 1- Be responsible for maintaining the confidentiality of your account information and password, and to notify the store immediately of any unauthorized use of your account information or any other breach of your secret information. 2- The store shall not be responsible in any case for any loss that may directly or indirectly, materially or morally, result from disclosing the consumer's name or login information. 3- You agree to use your account or membership in the store personally, as you are fully responsible for it, and if used by others, this is considered as your authorization for them to use the store on your behalf and account. 4- You agree to use the store seriously and credibly. 5- You agree to disclose truthful, accurate, updated, complete, and legal information about yourself as required during registration and to update your data if changed or needed. 6- Our store commits to dealing with your personal information and contact details in complete confidentiality. 7- If the store finds that you have disclosed false, incorrect, outdated, incomplete, illegal, or in violation of the usage agreement information, the store has the right to suspend, freeze, or cancel your membership or your store and account on the platform, without prejudice to the store’s other rights and legitimate means to recover its rights and protect other consumers. 8- In case of non-compliance with any of the above, the store management has the right to suspend or cancel your store or membership or block your access to the store’s services again. Article Six - Electronic Communications and Official Communication Means: 1- The parties to this agreement agree that communication is via the email registered on the platform. 2- The consumer agrees that all agreements, announcements, data, and other communications electronically provided are equivalent to their written counterparts and are considered standalone evidence to meet legal and regulatory needs. 3- The consumer agrees that the store may contact him and notify him of any provisions related to this agreement or dealing with him through broadcasting general messages to all consumers or specific store users. Article Seven - Modifications to the Terms of Use and Fees: 1- If any article or clause in this agreement is canceled or becomes non-applicable, this does not cancel the validity of the remaining articles, clauses, rules, and provisions of this agreement, which remain valid until further notice from the store management. 2- This agreement, which is periodically amended as needed, constitutes the mechanism of work, understanding, and agreement between (the consumer) and (the store). 3- The store may impose fees on some consumers depending on the offers, products, or services they request or the fees or taxes imposed by the state on the nature of the product or service. 4- The store reserves the right to add, increase, decrease, or discount any fees or expenses according to the articles, clauses, and provisions of the usage agreement, on any of the consumers regardless of the reason for their registration. Article Eight – Payment and Settlement Services in the Store: 1- The store provides a payment and settlement system through its partners, which can be entirely online via the available payment options on the store or through any payment method it provides from time to time. 2- The store commits to set the price of the service or product it offers according to the recognized market value. 3- The store commits to providing invoices, collection receipts, and delivery notes for all amounts and profits generated in its store, and to give the consumer an invoice for his purchase of a service or product. 4- The store commits to providing accounting specifications recognized in its electronic store, in accordance with the provisions of this agreement, and for the legal, economic, commercial, and regulatory interests involved. Article Nine – Intellectual Property: 1- The intellectual property rights of the store are fully owned by the store, whether owned before or after establishing this electronic platform. 2- The consumer respects the store’s intellectual property rights, including the store’s name itself, words, logos, and other symbols displayed on it, as each right following the store’s name is a full intellectual property right owned by the store. Article Ten - Store Responsibility: 1- The store commits to practicing its business through this electronic platform in a systematic manner and in accordance with the applicable laws in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement. 2- The store is not responsible for any claims arising from errors or negligence, whether directly, indirectly, incidentally, by the consumer, or through a third party such as shipping companies. 3- The (store name), its affiliates, owners, and representatives shall ensure that (the product or service) is legitimate, lawful, and approved according to the laws and regulations of the Kingdom of Saudi Arabia and used for lawful purposes. Article Eleven - Restriction of Access or Membership: The store may suspend or cancel the consumer’s membership or restrict the consumer’s access to the platform’s services at any time and without prior notice and for any reason, without specification. Article Twelve - Applicable Law or System: This usage agreement is governed and drafted in accordance with the laws, regulations, and legislations in force and valid in the Kingdom of Saudi Arabia, and is fully subject to the regulations of the authorities in the Kingdom of Saudi Arabia. Article Thirteen - General Provisions: If any article or clause in this usage agreement is canceled or becomes non-applicable, this does not cancel the validity of the remaining articles, clauses, and provisions, which remain valid until further notice from the store management. This usage agreement — which may be periodically amended as needed — constitutes the usage agreement and the mechanism of work, understanding, agreement, and contracting between the store and the consumer, and both parties agree to consider the following: 1- The Arabic language is the language used in interpreting the provisions of this agreement or when translating it into another language. 2- All prices displayed for services or products of the store may be amended from time to time. 3- Promotional or marketing offers that the store may place are temporary offers, and the store has the right to modify or stop these promotional or marketing offers at any time. 4- The parties to this agreement commit to dealing with each other in a manner that does not violate Sharia rules, applicable regulations, and laws related to the nature of the store and consumer dealings. 5- This usage agreement is only canceled by a decision issued by the store management. Golden Warranty: Return Policy: 1- Without prejudice to the provisions of the contractual and regulatory warranty, the consumer has the right to replace the product provided to him by the store within seven days from the date of receipt of the product, and he cannot replace the product after passing seven days. 2- The condition for replacing the product is that the product is in good condition and that the consumer has not used the product or benefited from it, and (Alfaaq Aljouf) has the right to inspect the product before replacing it to ensure its safety. The consumer bears the cost of shipping if he wishes to replace the product, and in international replacement, the consumer bears all shipping and delivery costs to the shipping company. If there are defects or errors, the consumer will be compensated. The consumer is not entitled to replace the product in the following cases: 1- If the product was manufactured based on the consumer’s request or according to specifications he set, except for products with a defect or that violated the specifications set by the consumer. 2- If the product consists of video tapes, discs, or software that has been used. 3- If the product consists of newspapers, magazines, publications, books, or other works considered intellectual property. 4- If a defect appears in the product due to poor handling by the consumer. 5- If the contract involves providing accommodation, transportation, or catering services. 6- If the contract involves purchasing software downloads online. Return Policy: 1- Without prejudice to the provisions of the contractual and regulatory warranty, the consumer has the right to cancel the contract and retrieve the product provided to him by the store within seven days from the date of receipt, and he cannot do so after passing seven days. 2- The condition for returning the product is that it is in good condition and that the consumer has not used it or benefited from it, and the store has the right to inspect the product before returning to ensure its safety. 3- The consumer bears the costs of the return process, and in the case of international return, the consumer bears all shipping and delivery costs to the shipping company. If there are defects or errors, the consumer will be compensated. The consumer cannot return the product in the following cases: 1- If the product was manufactured based on the consumer’s request or according to specifications he set, except for products with a defect or that violated the specifications set by the consumer. 2- If the product consists of video tapes, discs, or software that has been used. 3- If the product consists of newspapers, magazines, publications, books, or other works considered intellectual property. 4- If a defect appears in the product due to poor handling by the consumer. 5- If the contract involves providing accommodation, transportation, or catering services. 6- If the contract involves purchasing software downloads online.
